Kevin Costner Moves to Dismiss Stuntwoman’s Lawsuit
Kevin Costner Seeks Dismissal of Stuntwoman’s Sexual Harassment Lawsuit
Kevin Costner is seeking to have a sexual harassment lawsuit filed by stuntwoman Devyn LaBella dismissed.
The 70-year-old actor and director has been named in a legal complaint alleging he was involved in an “unscripted, unscheduled rape scene” during the filming of Horizon: An American Saga – Chapter 2 in May 2023. LaBella claims she was not informed about the scene in advance and accuses Costner of sexual harassment, discrimination, creating a hostile work environment, retaliation, and breach of contract.
In newly filed court documents, Costner’s legal team denies the allegations and requests the lawsuit be thrown out. They argue that LaBella had expressed satisfaction with the production, pointing to a text she allegedly sent to a supervisor thanking them after filming wrapped.
Costner’s declaration outlines a different account of the scene in question. According to his statement, the moment was included in the script and involved LaBella, fully clothed in bike shorts and an ankle-length dress, lying beside actor Roger Ivens in a covered wagon. Costner states that the action was limited to Ivens lifting the hem of LaBella’s dress and positioning himself on all fours above her.
“There was no nudity, simulated sex, simulated rape, physical contact, fighting, gyrating, or any physicality other than Devyn’s outer dress being pushed from her ankles to her knees,” the declaration reads.
