“Kevin Costner Faces Legal Setback Amid Se*ual Harassment Lawsuit from ‘Horizon 2’ Stunt Performer”

Judge Allows Devyn LaBella’s Lawsuit Against Kevin Costner to Move Forward With Some Claims Dismissed

A sexual harassment lawsuit filed by Horizon: An American Saga – Chapter 2 stunt performer Devyn LaBella against actor and director Kevin Costner will proceed, though with some limitations.

On Thursday, October 16, a Los Angeles judge denied the 70-year-old actor’s request to dismiss the case entirely. Costner’s legal team, led by attorney Marty Singer, had attempted to have the case thrown out under California’s anti-SLAPP statute, which aims to protect individuals from meritless lawsuits intended to chill free speech. However, while the court rejected the effort to dismiss the entire case, it did grant part of the motion — striking two of the ten claims brought by LaBella.

One of the dismissed claims included an alleged violation of California’s Bane Act, a law designed to combat hate crimes. The judge concluded that LaBella failed to present sufficient evidence to support that accusation. A second dismissed claim involved one of LaBella’s two sexual harassment allegations. The court found that the law in question applies only to harassment that occurs outside the workplace. Because the alleged misconduct took place during the course of LaBella’s employment, the judge ruled that particular claim legally untenable.

Despite those dismissals, eight of LaBella’s claims remain, including sexual harassment, sex discrimination, retaliation, and breach of contract.

In response to the ruling, Costner’s attorney issued a statement reiterating the actor’s denial of any wrongdoing.

“We were pleased to learn that the Court granted our anti-SLAPP motion in part, dismissing two of the plaintiff’s claims (including one of her claims for sexual harassment),” Singer said. “While we were disappointed with the Court’s decision to allow her remaining causes of action to proceed, the evidence is clear that they have no legal or factual merit, and we plan to appeal the Court’s decision promptly.”

Singer went on to call LaBella’s claims “outlandish,” insisting that “there was never any ‘simulated rape,’ ‘simulated sex’ or sexual harassment — and absolutely no retaliation.”

“She is seeking millions of dollars for agreeing to participate in the rehearsal of a single, benign shot that even she admits was explained to her in advance,” Singer added. “We will continue to fight for the truth, and we are extremely confident we will prevail.”

Meanwhile, LaBella’s legal team welcomed the court’s decision to allow the majority of the claims to move forward.

“The court stood with Devyn and recognized the strong merits of her case — an important step toward uncovering the truth and creating accountability for those who abuse their power,” her representatives said. “We hope the Defendants won’t waste any more time on frivolous motions and stall tactics, and instead allow the case to proceed to discovery, where witnesses on set will speak to what truly transpired.”

LaBella was hired as the lead stunt double for actress Ella Hunt, who plays Juliette in Horizon: Chapter 2. In May 2025, she filed the lawsuit alleging sexual harassment, discrimination, and a hostile work environment during the film’s production.

Costner has categorically denied all accusations.

“Kevin Costner always wants to ensure everyone feels safe and respected on set,” a prior statement from his team read. “This claim by Devyn LaBella has no merit and is completely contradicted by her own actions and the facts.”
