Kevin Costner Sued Over Alleged Unscripted Rape Scene on Horizon 2 Set
Kevin Costner is facing a lawsuit filed by stunt performer Devyn LaBella, who alleges she was subjected to a “violent, unscripted, unscheduled” simulated rape scene during the filming of Horizon: An American Saga – Chapter 2 in Utah on May 2, 2023.
The lawsuit, filed in Los Angeles County Superior Court, includes claims of sexual discrimination, harassment, creation of a hostile work environment, retaliation, and intentional infliction of emotional distress. LaBella, 34, accuses the production of failing to follow proper protocols during the filming of the alleged scene.
Marty Singer, attorney for Costner, strongly denied the allegations, stating that the claims have “absolutely no merit.” He added that LaBella had rehearsed the scene in character, communicated her readiness to perform, and was never required to actually film the scene.
According to the complaint, LaBella was the lead stunt double for actress Ella Hunt. She alleges that production conditions changed on May 2 when Costner requested a last-minute, unscheduled scene not listed on the call sheet. The scene reportedly involved actor Roger Ivens simulating a violent rape, which led to Hunt walking off set, visibly distressed.
LaBella claims she was not informed that Hunt had exited the scene and was asked to stand in. Believing it to be a routine stunt, she agreed, but alleges she was unaware of the scene’s nature until Ivens was already on top of her.
The complaint states that the scene was performed without an intimacy coordinator present, in violation of industry protocols. It also alleges that performers must receive a written rider outlining such scenes at least 48 hours in advance — a requirement LaBella claims was ignored.
After raising concerns with the intimacy coordinator, LaBella says she was not brought back for Horizon 3, which began filming in early 2024.
“On that day, I was left exposed, unprotected, and deeply betrayed by a system that promised safety and professionalism,” LaBella said in a public statement. “This experience has ignited in me a lifelong mission to be the advocate I once needed.”
The lawsuit seeks compensatory and punitive damages, a public apology, mandatory anti-harassment and anti-sexual violence training for the production team, and the inclusion of an intimacy coordinator on all future projects.
Horizon: An American Saga is a four-part Western series developed by Costner, chronicling the settlement of the American West. While a passion project for the actor-director, the series has received mixed reviews.
